Terms of Service
Effective date: October 1, 2026
These Terms of Service ("Terms") are an agreement between you and Clinton McWilliams, an individual doing business as CybersecurityNews.us ("CybersecurityNews.us", "we", "us") and govern your use of cybersecuritynews.us, its alerts and notifications, its feeds, and its Data API (together, the "Service"). By using the Service, creating an account, or using an API key, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Please read the sections "Information only, not professional advice", "Disclaimer of warranties", "Limitation of liability" and "Disputes": they limit our responsibility to you and affect your legal rights.
Eligibility
You must be at least 18 years old, or the age of majority where you live, to create an account or use the Data API. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it, and "you" includes that organization.
The Service
CybersecurityNews.us publishes cybersecurity news, vulnerability and threat information, summaries of reporting by other publishers and public sources, automated classifications (such as severity, required action, exploitation status and threat status), personalized briefings, alerts, and data made available through feeds and the Data API.
We may add, change, suspend or remove any part of the Service at any time, with or without notice, and we are not liable to you for doing so.
Information only, not professional advice
The Service is provided for general information only. It is not professional security, legal, compliance or other advice, and it does not create any professional or advisory relationship.
- Information on the Service may be incomplete, inaccurate, out of date or delayed. Security situations change quickly. Vendor advisories, the National Vulnerability Database, CISA and other sources may correct or change information after we publish it.
- Classifications, severity ratings, "what you should do" guidance, threat status levels and similar outputs are produced in part automatically by rules and software. They are estimates, not determinations about your systems.
- You are solely responsible for your systems, networks, data and decisions, including whether and how to patch, mitigate, disclose or respond to any issue. Always verify information with the affected vendor and qualified professionals before acting on it.
- You agree that you will not rely on the Service as your only source of security information, and that we are not responsible for any action you take or fail to take based on it.
Alerts and notifications are best effort
Email alerts, digests and browser notifications are provided on a best-effort basis. They may be delayed, incomplete, filtered as spam, or not delivered at all, and they may be paused at any time. Do not rely on the Service to notify you of any vulnerability, incident or threat, or as part of any incident-response, compliance or safety-critical process.
Third-party content and links
The Service includes headlines, short excerpts and links from other publishers, vendors and government sources. That content belongs to its owners and is provided for reference, with attribution. We do not control, endorse or take responsibility for third-party content, websites, products or services, and your use of them is at your own risk and subject to their terms.
Your account
- Give us an email address you control and keep it current. You are responsible for all activity under your account and for keeping access to your email secure.
- Accounts are personal: do not share your account or sign-in links.
- Tell us promptly at security@cybersecuritynews.us if you believe your account or API keys have been compromised.
- We may suspend or close accounts that violate these Terms, that pose a security risk, or that have been inactive for a long time.
Acceptable use
You agree not to, and not to help anyone else to:
- break the law or infringe anyone's rights;
- attack, probe, scan or test the vulnerability of the Service, or bypass its security, authentication, rate limits or bot checks, except through a coordinated disclosure as described in our security.txt file;
- disrupt or overload the Service, or access it with automated tools except through the Data API under the API terms below;
- scrape, crawl, copy or harvest content or data in bulk, or build or train a competing product or dataset from the Service outside the Data API;
- create accounts or API trials by automated means, under false identities, or to get around trial limits;
- reverse engineer the Service, except where the law expressly allows it;
- use the Service to send spam, or to harass, deceive or harm anyone;
- misrepresent our content, remove attribution, or suggest that we endorse you.
Our content and your license
The Service, including its software, design, text, classifications, compilations and data, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own information. RSS and JSON feeds may be used in personal or internal tools. Any other reproduction, redistribution or commercial use requires the Data API under the API terms or our written permission.
If you send us feedback or suggestions, we may use them without any obligation to you.
Data API terms
These terms apply in addition to the rest of these Terms whenever you use an API key.
- Keys. Keep your API keys secret and do not embed them in public code or client-side applications. You are responsible for all use of your keys. Revoke or rotate a key immediately if it may be exposed.
- Plans and limits. Use the API only within your plan's rate limits, quotas and history window. We may throttle, suspend or revoke access that exceeds them or that we reasonably believe is abusive.
- Free trials. Trials are limited to one per person or organization. We may end, shorten or refuse a trial at any time. When a trial ends, API calls return an error until you move to a paid plan; your account, keys and settings are kept.
- Attribution. When you display or republish data from the API, credit CybersecurityNews.us and keep the source attributions and links included in the data.
- Restrictions. Do not resell, sublicense or redistribute the raw data in bulk, offer it as a competing data feed, or use it to send unsolicited messages. Do not combine keys or accounts to exceed limits.
- No service level. The API is provided without any uptime, availability, latency, accuracy or support commitment, unless we agree otherwise in a separate signed agreement. We may change, version or retire endpoints and fields, and will try to give notice of breaking changes on our developer pages where practicable.
- Your applications. You are solely responsible for your applications and for how you use the data, including any decisions, alerts or actions they make based on it.
Subscriptions
These terms apply when you buy a paid plan, such as Subscriber. The plan's price, billing interval and features are shown on our pricing page and at checkout, and form part of these Terms.
- Automatic renewal. Your subscription renews automatically at the end of each billing period (each month or each year, the one you chose) for another period of the same length. We charge the payment method you gave at checkout at the start of each new period, at the price that applies to your plan, until you cancel. By subscribing you authorize these recurring charges.
- Cancelling. You can cancel at any time in your account (Account → Plan → Manage billing), without contacting us. Cancellation takes effect at the end of the period you have already paid for: you keep the paid features until then and are not charged again.
- Refunds. Except where the law requires otherwise, payments are not refundable, including for the unused part of a period. If you believe you were charged in error, contact us within 60 days of the charge and we will correct any genuine error.
- Deleting your account. If you delete your account while subscribed, your subscription is canceled immediately and the remainder of the paid period is not refunded. To use the plan until the period ends, cancel first and delete your account later.
- Price changes. We may change prices for future billing periods. We will email you at least 30 days before a new price applies to your renewal, so you can cancel first. A price change never applies to a period you have already paid for. The founding price offered to early subscribers is not increased for as long as that subscription continues without interruption.
- Failed payments. If a renewal payment fails, our payment processor retries it over several days. The paid features may continue briefly during that time, and end if the payment does not succeed.
- Taxes. Prices are in US dollars. Where sales tax or similar taxes apply, they are added at checkout.
- Payment processing. Payments are processed by Stripe, Inc. under its own terms and privacy policy. We do not receive or store your full card number.
- Promo codes and complimentary access grant a plan for the period stated. They do not renew and do not charge you unless you subscribe.
- Changes to a plan's features. We may improve or change what a plan includes, but we will not materially reduce the core features of a period you have already paid for.
Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT, DATA, ALERTS AND API RESPONSES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT ALERTS WILL BE DELIVERED, OR THAT ANY INFORMATION IS ACCURATE, COMPLETE OR CURRENT. YOU USE THE SERVICE AT YOUR OWN RISK.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, OR ANY SECURITY INCIDENT, BREACH, DOWNTIME OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
- THESE LIMITS APPLY TO ALL THEORIES OF LIABILITY, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY AND ANY OTHER THEORY, AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, our liability is limited to the smallest extent the law permits, and nothing in these Terms limits liability that cannot be limited by law.
Indemnification
You will defend, indemnify and hold harmless CybersecurityNews.us and its owners, operators, employees and contractors from any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your applications or content, your violation of these Terms, or your violation of any law or third-party right.
Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms, created risk or possible legal exposure for us, or if we discontinue the Service. The sections on our content, feedback, disclaimers, limitation of liability, indemnification and disputes survive termination.
Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms here with a new effective date and, for material changes, notify account holders by email or on the Service before they take effect. Your continued use of the Service after the changes take effect means you accept them.
Disputes
- Governing law. These Terms are governed by the laws of the State of Arkansas and applicable U.S. federal law, without regard to conflict-of-laws rules.
- Informal resolution first. Before filing any claim, you agree to contact us at support@cybersecuritynews.us and try to resolve the dispute informally for at least 30 days.
- Venue. You and we consent to the exclusive jurisdiction of the state courts located in Johnson County, Arkansas, and the United States District Court for the Western District of Arkansas, except that either of us may bring an individual claim in small-claims court if it qualifies.
- Time limit. To the extent permitted by law, any claim must be brought within one year after it arises.
General
These Terms, together with the Privacy Policy and any plan terms shown at purchase, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. We may give you notices by email to your account address or on the Service.
